There was a motion to accept the minutes of the October 4th, 2012 meeting with 2 corrections.   The motion was seconded and accepted with a vote of 4-0-2; 4 Yes, 0 No, 2 Abstentions.

Ms. Michele Grenier’s Agent’s Report has been appended to the minutes.

GENERAL BUSINESS

Certificates of Compliance:  Residences at Union Place – Upper Union Street
Michele Grenier, Conservation Agent, informed the Commission that she has visited the site with Bill Yadisernia, Town Engineer, to inspect the detention basin clean-up.  The clean-up work was excellent; all of the invasive species were removed.  Ms. Grenier recommended that the Commission issue the Certificate of Compliance.

There was a motion to issue 2 Certificates of Compliances; 1 for the invalid Orders of Conditions  for the Residences at Union Place.  The motion was seconded and accepted with a vote of 6-0-0.

Minor Buffer Zone Activity:  86 Populatic Street
Ms. Ernest Savoie, the applicant, appeared before the Commission to remove several trees that are a danger to the house and 1 tree is rotted as well.  Ms. Grenier stated that she visited the site and recommends taking these trees down.    

There was a motion to issue a Negative Determination subject to 3 conditions; the applicant must notify staff when they begin and end the work and that the work is performed according to the plan.  The motion was seconded and accepted with a vote of 6-0-0.

Discussion:  Cook’s Farm – East Central Street
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, Ms. Judy Schmitz, PWS, and Mr. Ron Roux, prospective buyer for the property, both appeared before the Commission for a discussion regarding this site.

Mr. Nielsen submitted plans depicting wetland resource areas for the site.  Mr.Nielsen gave the Commission members a detailed overview of this plan.    

Ms. Schmitz has delineated the resource areas on the property and has submitted a letter reporting her findings which has been submitted to the Commission.  Mr. Nielsen presented the Commission with a detailed description and explanation of her findings.

Ms. Schmitz gave an overview of her findings to the Commission regarding the BVW and resource areas on the site.  In her opinion, the stream on the site is intermittent not perennial.
An Anrad will be forthcoming

Mr. Roux gave the Commission some background information on his company and his plans for the site.  Mr. Roux requested that the Commission members conduct a site walk of the property.  

Ms. Grenier, Conservation Agent, stated that the applicant should file an ANRAD for this project and recommended that the Commission then conduct a site walk.

The Commission members stated that they will be hiring their own consultant to walk the site and review the riverfront and bordering vegetated wetlands on their behalf.  There would be a fee required to compensate the consultant.

The Commission members will conduct a site walk of the property on Sunday, November 4th at
9 a.m.    

The Commission members will coordinate with the consultant to review the site.

Discussion:  360 West Central Street
Michele Grenier, Conservation Agent, informed the Commission members that the property owner has altered all of the riverfront area and water has percolated up through the soil.  The applicant did not come to Conservation for a permit in order to perform this work.

The property owner does not have a farm plan for the site.

The Commission came to the consensus that an Enforcement Order should be sent to the property owner and require that they appear at the next Conservation Commission meeting.



Discussion:  Conservation Commission 2013 Schedule
The Conservation Commission 2013 meeting schedule has been distributed to the Commission members for approval.

There was a motion to approve the Conservation Commission schedule for 2013 as detailed on the attached calendar.  The motion was seconded and accepted with a vote of 6-0-0.

Discussion:  Dover Circle Illegal Dumping  
Michele Grenier, Conservation Agent, informed the Commission that she has received several emails regarding illegal dumping of leaves and yard debris on Town land as well as wetlands on Dover Circle.  She sent a letter to the residents in the immediate area and has received no response.

The Commission requested that Ms. Grenier serve all residents on Dover Circle with notice that if this activity does not cease and dumping continues, a $500 fine will be issued.   

Michele Grenier will put up signs giving notice that this illegal dumping is not allowed.  The DPW will clean out the debris from the site.

Continued - Public Hearing - Notice of Intent – 4 Bogastow Brook Lane – Walsh - CE159-1038
The applicant’s representative submitted a letter requesting that the hearing be continued until the meeting on November 15th, 2012.

There was a motion to adjourn.  The motion was seconded and accepted with a vote of 6-0-0.
